From Asylum To The Keystone Pipeline, Obama’s Judges Continue Thwarting Trump

To the Lawyer Left, elections represent a policy choice only when Democrats win.

As I write on Friday, the restraining order hasn’t come down yet. But it’s just a matter of time. Some federal district judge, somewhere in the United States, will soon issue an injunction blocking enforcement of the Trump administration’s restrictions on asylum applications.

The restrictions come in the form of a rule promulgated jointly by the Departments of Justice and Homeland Security, and a proclamation issued by President Trump. In conjunction, they assert that an alien who wishes to apply for asylum in the United States must act lawfully: An alien who is physically present here and wishes to apply must be in the country legally; an alien outside the country who wishes to apply must present himself at a lawful port of entry — not attempt to smuggle his way in or force his way in as part of a horde (i.e., no invasions by caravan)….

Trump Administration Rolls Back Obamacare’s Birth Control Rule

The Trump administration will exempt employers from providing insurance coverage for birth control if it conflicts with their religious or moral beliefs, scaling back a rule created under the Obama administration.

The rule, released Wednesday, will take effect in 60 days and will affect between 6,400 and 127,000 women, according to the Trump administration. The religious exemption applies to any type of employer, but the moral exemption doesn’t apply to publicly traded businesses or government entities….

Birthright Citizenship Is An Open Legal Question Americans Should Decide

Does the 14th Amendment mandate that the children born of illegal immigrants and birth tourists are automatically American citizens? The answer is not as obvious as has been suggested in the press.

President Trump’s announcement that he would alter the rules of birthright citizenship by executive order is the latest episode in his administration’s push against the immigration system that has prevailed since 1986. It also shows again how the fight over policy choices in America is increasingly waged in the courts and through executive action instead of where it is meant to take place: in Congress….

9th Circuit Blocks Trump’s Moves To End DACA

A federal appeals court upheld a nationwide injunction against President Donald Trump’s termination of the Deferred Action for Childhood Arrivals (DACA) program Thursday.

A three-judge panel of the U.S. Court of Appeals for the 9th Circuit concluded DACA’s recension “is arbitrary, capricious, or otherwise not in accordance with law.”

Supreme Court action could soon follow. The Trump administration asked the high court to intervene in the DACA cases Monday. The move was highly unusual, as three federal appeals courts, including the 9th Circuit, are separately reviewing orders requiring the government to continue administering DACA. The justices seldom review a case before the circuit courts issue judgment….

Top Democrat: Dems To Go ‘All-In’ On Russia, Impeach Kavanaugh

Also laments that elite Republicans are joining Democrats.

Judiciary Committee ranking member Rep. Jerrold Nadler, D-N.Y., revealed plans for House Democrats to investigate and impeach Justice Brett Kavanaugh for alleged perjury and investigate and impeach President Donald Trump for alleged treasonous collusion with Russia.

In post-election chats with various callers while riding the Acela train from New York to Washington, Nadler gave advice to a newly elected representative and discussed potential 2020 Democratic presidential nominees with another. He also lamented identity politics and the thriving economy and worried about Democrats losing working-class voters while gaining elite former Republicans and suburban women….

Kavanaugh Report Reveals ‘Mistaken Identity’ Claims – Grassley Probe Concludes ‘No Evidence’ To Back Sexual Assault Allegations

Senate Judiciary Chairman Chuck Grassley (R-IA) released a 414 page report on Brett Kavanaugh over the weekend and confirmed that there is no credible evidence to support the sexual assault allegations.

The Committee interviewed 45 individuals and took 25 written statements relating to the various allegations against Kavanaugh, the Senate Judiciary said….

Democrats Will Use The Power Of The House To Impeach Trump And Kavanaugh And ‘Vindicate Their View Of Government,’ Says Judge Napolitano

Fox News senior judicial analyst Judge Andrew Napolitano said if the Democrats flip the House, they’ll use their newfound power to “vindicate their view of government” by going after President Donald Trump and Supreme Court Justice Brett Kavanaugh.
