From Asylum To The Keystone Pipeline, Obama’s Judges Continue Thwarting Trump

To the Lawyer Left, elections represent a policy choice only when Democrats win.

As I write on Friday, the restraining order hasn’t come down yet. But it’s just a matter of time. Some federal district judge, somewhere in the United States, will soon issue an injunction blocking enforcement of the Trump administration’s restrictions on asylum applications.

The restrictions come in the form of a rule promulgated jointly by the Departments of Justice and Homeland Security, and a proclamation issued by President Trump. In conjunction, they assert that an alien who wishes to apply for asylum in the United States must act lawfully: An alien who is physically present here and wishes to apply must be in the country legally; an alien outside the country who wishes to apply must present himself at a lawful port of entry — not attempt to smuggle his way in or force his way in as part of a horde (i.e., no invasions by caravan)….

DHS: Less Than 10 Percent Of Migrants Have Legitimate Asylum Claims

Less than 10 percent of the migrants arriving at the United States-Mexico border from Central America have legitimate asylum claims, new Department of Homeland Security (DHS) data reveals.

As President Trump’s administration releases new asylum rules — blocking illegal border crossers from claiming asylum in the U.S. — DHS data notes that the overwhelming majority of Central American migrants who claim “credible fear” do not have legitimate asylum claims.

The issue of the country’s loose asylum laws — where foreign nationals can claim that they fear for their lives in their native country and be released into the U.S. until their day in court — has sparked debate as a caravan of 7,000 to 10,000 Central Americans heads to the U.S….

Trump Issues Proclamation Revoking Asylum Eligibility From Migrants Who Cross Southwest Border Illegally

President Donald Trump issued a proclamation on Friday that makes anyone caught crossing the southwest border illegally ineligible for asylum, a major change to U.S. immigration policy that seeks to reverse the rising tide of migration from Central America.

The order, which takes effect midnight Saturday, suspends for 90 days the entry of any alien across the U.S.-Mexico border, with broad exceptions for people who present themselves for inspection at ports of entry and legal permanent residents.

When combined with a new asylum regulation issued Thursday, the practical effect of the proclamation is to limits asylum protections to only those migrants who present themselves at U.S. ports of entry. Administration officials say the ultimate aim of the policy is to channel asylum seekers away from illegal border crossings, which have surged this year amid a wave of Central American migrants….

8 Ways In Which Jeff Sessions Sucked

The former attorney general’s worst hits

On his way out the door yesterday, former Attorney General Jeff Sessions took credit for reversing an upswing in violent crime. “We prosecuted the largest number of violent offenders and firearm defendants in our country’s history,” he said in his resignation letter.

“We took on transnational gangs that are bringing violence and death across our borders and protected national security. We did our part to restore immigration enforcement. We targeted the opioid epidemic by prosecuting doctors, pharmacists, and anyone else who contributes to this crisis with new law enforcement tools and determination. And we have seen results. After two years of rising violent crime and homicides prior to this administration, those trends have reversed—thanks to the hard work of our prosecutors and law enforcement around the country.”

It is true that the murder and violent crime rates went up in 2015 and 2016 before falling in 2017, but it is ludicrous for Sessions to suggest that he is responsible for that improvement. Leaving aside the limited role that the federal government plays in criminal justice, Sessions wants us to believe that things he did after taking office in February 2017 had an immediate, magical effect on violence, such that there were 3,341 fewer murders that year than in 2016….
